Imagine this scenario: You purchase an airline ticket in September for a flight scheduled in October. Days before departure, the airline cancels the flight and refuses to refund your fare. The FCCPA was enacted to establish a comprehensive framework promoting fair competition and safeguarding consumer rights across all sectors of the Nigerian economy. Section 127(1) of the Act prohibits service providers from imposing terms that are manifestly unfair, unreasonable, or unjust, including “no refund” policies that contravene consumer rights.

Nigerian Civil Aviation Authority (NCAA) Regulations 2023

The NCAA is the federal body responsible for regulating aviation safety, overseeing airport standards, and enforcing aviation laws and policies in Nigeria. Through the Nigerian Civil Aviation Authority Regulations 2023, the NCAA safeguards passengers’ rights, addressing issues such as flight cancellations, delays, and baggage handling.

Part 19 of the NCAA Regulations stipulates that airlines must refund passengers within 14 days after a flight cancellation or delay. Failure to comply with this timeframe can result in sanctions against the airline.

Steps to Take if Your Flight Is Canceled and Refund Is Denied

  1. Engage the Nigerian Civil Aviation Authority (NCAA) by submitting a complaint to the NCAA’s Consumer Protection Directorate, citing a breach of Part 19 of the NCAA Regulations. You can do this by completing the complaint form on the NCAA website at ncaa. gov. ng or by sending an email to cpd@ncaa.gov.ng. Complaints can also be submitted in person at any NCAA office.
  2. Escalate to the Federal Competition and Consumer Protection Commission (FCCPC): If the NCAA fails to resolve the issue, you can escalate the matter to the FCCPC by submitting a complaint through the FCCPC’s automated complaint resolution portal at fccpc.gov.ng. Alternatively, you can use the FCCPC Consumer Complaint App available on Google Play Store and the iOS App Store, send a complaint via email to contact@fccpc.gov.ng, or visit any FCCPC office nationwide.
  3. Initiate Legal Proceedings: If all administrative options fail, you may consider initiating legal proceedings against the airline for breach of contract and violation of your rights as a consumer under the FCCPA and sue the airline claiming damages.
